Individualized Education Program (IEP)
Before students can receive special education and related services, they must have an IEP in place. The IEP is a written plan that sets forth the special education programs and services the child will receive. The educational plan should be based on observations and recommendations by people (parents and teachers) who know the child well, and objective information from the various tests and assessments conducted as part of the evaluation process. The IEP includes, but is not limited to, the following information:
- Information about the childs present levels of academic achievement and functional performance statement (PLAAFP) on various tests and measures.
- Information about the childs educational goals and objectives.
- Avenues for parents and educators to measure the childs progress toward the goals and objectives.
- All the programs and services necessary to meet the childs individual needs as identified during the evaluation and re-evaluation process.
The IEP is developed collaboratively at a conference by a team (IEP Team) that includes but is not limited to:
- Parent (adult student).
- Teacher who is knowledgeable about the students educational performance or district programs.
- Case manager.
- Minor pupil, if appropriate.
- Person referring the pupil as potentially disabled, or the principal or designee.
- At least one CST member who participated in the evaluation.
Within fifteen (15) days of the IEP meeting the parent (adult student) shall be provided with:
- Written notice of the determinations and proposed actions, including:
A. Eligibility
B. Proposed IEP
C. Proposed educational placement
- A request for written consent from the parent (adult student).
- A copy of the short procedural safeguards statement (SPSS).
- A copy of the evaluation reports and determination of eligibility.
The parent (adult student) shall have fifteen (15) days from receipt of the above to consider the determination of eligibility and proposed program. After fifteen (15) days the student is considered Eligible for Special Education and Related Services if the parent (adult student) do not disagree by requesting mediation or a due process hearing.
